Man will go on trial for sexual intercourse without consent and incest

GREAT FALLS - Travis McAlister, charged with two counts of sexual intercourse without consent and incest, had hoped to settle on a sentence, but now he will learn his fate through a trial instead.

McAlister and his defense asked for a binding plea agreement of three years to the Montana Department of Corrections.

But after McAlister refused to agree to a psychosexual evaluation test, the judge turned it down.

In March 2013, McAlister was arrested after a four-year old child told police that she and McAlister drank beer and watched inappropriate movies, and then he sexually molested her.

Although he is not the child's biological father, he has been considered the father through common-law since the child's birth.

A trial date has not yet been set.


(March 29, 2012) Travis Morgan McAlister of Great Falls, accused of sexually assaulting a four-year old girl, appeared in court on Thursday.

McAlister is charged with two counts of sexual intercourse without consent, and incest.

According to court documents, earlier this week police responded to a report that the girl told her grandmother that she and her father have sex.

McAlister is not the child's biological father, but has been considered the father through common law since the child's birth.

During a forensic interview the child reportedly told police that she and McAlister drink beer and watch inappropriate movies, and then her father sexually molests her.

During a police interview, McAlister denied the allegations and said the child is making these stories up.

According to authorities McAlister says the child got into his pornography without his permission, and has seen him sexually active with his girlfriend.

Police say the child "described these acts in great detail."

McAlister is currently on probation for burglary in Sanders County.

His bail has been set at $100,000.
