HELENA - The man who tried to rob a Papa John's Pizza store in Helena in January, has agreed to a lesser charge.
David Randall Lacey changed his plea from robbery, to assault with a weapon, telling Judge Mike Menahan that he had a knife and threatened the store clerk that he would use it unless he was given money.
The knife later fell out of his pocket. The man left with only a pizza and some hot wings free of charge, but was later found and arrested.
He also pleaded guilty to selling an eighth of a gram of meth to an informant in another case.
Lacy will be sentenced July 3. The maximum penalty is 20 years in prison, with a $50,000 fine on the assault with a weapon charge.
