Butte - An 80-year-old Butte man has died after being struck by an alleged drunk driver. Now, the driver may face a more severe criminal charge.
Jack Lean, 64, of Butte is currently charged with felony negligent vehicular assault.
On March 3, Lean reportedly struck Thomas Kelly as he crossed the street near 2100 Farragut Avenue. Kelly suffered serious injuries and passed away on Thursday.
Now the county attorney's office is waiting on the results of medical records to determine if Lean will face a more severe charge.
